Kurzfassung/Abstract

After their victory in the elections of May 2011 the Scottish National Party (SNP) announced a referendum on Scottish independence, anticipated to be held in 2014. For many years the party has been assuring the Scottish people that it is Scotland’s natural right to be a sovereign and independent nation. It also claims her natural right to remain an EU member state after separation; consequently the party’s slogans were “Scotland in Europe” and “Independence in Europe”.
However, it seems that things are not so simple. With regard to international and European law, the Scottish people will depend on the cooperation of all European partner states to achieve their objectives. Scotland should not rely on it too eagerly.
